Can You Get Pre-Settlement Funding More Than Once on the Same Case?

A question we hear constantly from California clients: “I already got an advance six months ago, and my case still isn’t done. Can I get more?” The short answer is usually yes, within limits, though it depends on where your case stands today. Here is how repeat funding actually works.


Why Repeat Requests Are Common

Personal injury cases rarely move on a predictable schedule. A case that looked like a nine-month timeline at the first advance can stretch to eighteen or twenty-four months because of a slow-moving insurance carrier, a delayed deposition, or ongoing medical treatment. When the original advance runs out and the case still hasn’t resolved, a second request is a normal next step, not a red flag.


How Funders Evaluate a Second Advance

A second advance is underwritten the same way the first one was — by looking at the strength of the case and the room left between the current case value and what’s already been advanced (including any medical liens). If your case value has grown since the first advance, perhaps because treatment revealed a more serious injury or a demand letter went out at a higher number, there may be additional room. If the case hasn’t changed much, the room may be smaller.


Staged Funding vs. Reactive Requests

Some California funders, including us, prefer to structure funding in stages from the start: a smaller initial advance with a built-in option for additional advances later, rather than maxing out on day one. This approach generally costs less in total because fees only accrue on money you’ve actually received, and it leaves a documented plan rather than a series of one-off requests.


What to Watch For

Each additional advance adds to the total payback at settlement, so the sizing principle from earlier posts still applies: take only what closes the actual gap between now and the next real milestone in your case. Before requesting a second advance, it’s worth asking your attorney for an updated read on case value and timeline, ideally in writing so you have something concrete to compare against any new offer. If the numbers no longer support comfortable funding, that’s important to know before you ask, not after you’re approved and already counting on the cash.
